Based on the “test of legislative majority,” the electoral Commission gave Ajit Pawar’s group the NCP symbol in the midst of internal electoral disagreements.”This Commission holds that the faction led by the Petitioner, Sh. Ajit Anantrao Pawar, is the Nationalist Congress Party (NCP) and is entitled to use its name and reserved symbol “clock” for the purposes of the Election Symbols (Reservation and Allotment) Order, 1968,” the EC’s order said.

After more than ten hearings over the course of six months, the poll panel decided the NCP issue in favour of Ajit Pawar’s faction. The deadline for submitting three preferences to the commission and claiming a name for their new formation is 3 p.m. on February 7, as per the commission’s one-time offer.Strong legal teams from both sides were present during the proceedings, which began on July 1 of last year between the factions commanded by Sharad and Ajit Pawar. The petitioner’s team included Mukul Rohatgi, Neeraj Kishan Kaul, and Maninder Singh, while the respondent’s team included Abhishek Manu Singhvi and Devdatt Kamat.

Serious inconsistencies in terms of timelines in the Sharad Pawar group’s claim of having an organisational majority resulted in the unreliability of their claim, the panel stated.
