At the age of 95, eminent jurist and senior counsel Fali S. Nariman passed away in New Delhi early on Wednesday morning.
Nariman had been suffering from a number of medical conditions, including heart problems. According to family sources, the funeral service will take place on Thursday at the Parsi Aramgah in New Delhi at 10 a.m.
Known as the “Patriarch” or “Bhishma Pitamah” of the Indian judiciary, Nariman was bestowed with the Padma Vibhushan, the highest civilian honor in the nation. The senior advocate’s exceptional oratory skills and shrewd advocacy led to his prominent involvement in multiple bench cases involving the Constitution, which profoundly altered the legal landscape and contributed to the interpretation of its provisions.
As an attorney, Nariman was a key player in a number of historic cases, such as the Golak Nath case (which established that judicial review of constitutional amendments is permissible), the TMA Pai case (which upheld minorities’ rights to form institutions), and the SP Gupta and NJAC case (which promoted judicial independence in judge nomination).
A prolific writer, Nariman was also a former member of the Rajya Sabha. God Save the Hon’ble Supreme Court, “Before the Memory Fades,” “The State of the Nation,” and “India’s Legal System: Can it be Saved?” are only a few of the books he has written.
