Laptop worth rupees Rs 100 only ordered by a law student in Odisha was not delivered by Amazon. The company have been ordered to pay Rs 45,000 to that student for not providing the laptop.
The Odisha State Consumer Dispute Redressal Commission has penalised Amazon as compensation to Supriyo Ranjan Mahapatra, who is a law student.
But according to Amazon, the deal of 150 rupees of the laptop was between a third party agent and the customer on their online selling platform. And Amazon is not even considered as a party to their contract. Later the Odisha State Consumer Dispute Redressal Commission rejected Amazon’s contention that it was not a direct party to the agreement between the student and the laptop retailer.
In an official statement of the commission, it stated that there was an advertisement which made an offer placed by the OP Amazon who is a reputed Online Shopping Website and made an offer as per the materials available on record and the complainant placed the order, and same has been confirmed, the agreement is complete between the parties.
Later, Amazon is a leading online platform directed to pay 30,000 for the mental agony and harassment caused to that law customer, Rs 10,000 towards punitive damages and Rs 5,000 towards the cost of litigation.
Supriyo Ranjan Mahapatra, a law student, filed the case in 2014 for an unfair trade practice he faced on the Amazon website and had come across an offer on Amazon that allowed him to purchase a laptop worth Rs 23,499 for a mere price of Rs 190. But immediately after two hours, he was contacted by the Amazon Customer Care Service Department and was notified that the order was cancelled due to a price recession issue.
He later sent a legal notice to Amazon, but when it went unnoticed as there was no response from the company, he filed a complaint before the District Forum seeking Rs 50,000 for mental agony and Rs 10,000 towards the cost of litigation.
