The Central Bureau of Investigation (CBI) filed a FIR in the Balasore railway accident, which stipulates a five-year maximum penalty. The FIR was filed in accordance with sections 153, 154, and 175 of the Railway Act as well as sections 337, 338, 304A, and 34 of the IPC. Only Section 153 of the Railway Act, out of all these sections, allows for a maximum term of five years in prison; all the other sections only allow for sentences of two years or less. The CBI has taken over the investigation into the accident after the Odisha police initially filed the FIR.
The buggies of both trains capsized on June 2 at 6:55 p.m. as a result of a collision between Train No. 12841 Howrah-Channel Coromandal Express and Train No. 12864 Yesbantapur-Howrah Express, killing more than 100 people and injuring hundreds more. Rescue efforts are still going on with the dead corpse and injured person being sent to DHH Balasore, DHH Bhadrak, CHC Soro, and other hospitals. An FIR under sections 337, 338, 304A, and 34 of the IPC as well as 153, 154, and 175 of the Railway Act was filed based on this report since it revealed a cognizable case, according to the FIR.
At the scene of the railway accident, a CBI team is already there. On Monday night, it got to Odisha. The Coromandel Express, SMVP-Howrah Superfast Express, and a cargo train crashed and derailed on Friday evening at Bahanaga Bazar Railway station in Balasore, Odisha, resulting in at least 275 fatalities and over 800 injuries.
