The CBI withdrew its appeal from the Supreme Court on Tuesday after the apex court said it would be better if CBI withdraws its appeal against house-arrest order of four TMC leaders in Narada case since the matter is pending before the five-judge bench of Calcutta HC.
The SC however said that it did not approve of the conduct of West Bengal chief minister Mamata Banerjee and the state law minister in laying siege of the CBI office in Kolkata and thronging the trial court with supporters.
SC said the CBI is free to take action against the CM, law minister or anyone who attempted to subvert the rule of law and attempted to create law and order situations.
The SC observed that there is ample remedy provided in the Constitution to address the situation.
“We are not here to advise the CBI or government,” the bench said.
The bench of Justices Vineet Saran and B R Gavai also hinted at CBI not filing chargesheet against those TMC leaders named in Narada case who defected to BJP.
“Who is more in a position to influence witnesses – the men chargesheeted or those who have not been,” it asked.
The court also said it has not commented on merits of the CBI case.
