The Superintendent of MKCG Medical College and Hospital in Berhampur was previously ordered by the High Court to call a medical board and offer a decision about the minor’s pregnancy termination. The court’s ruling heavily relied on the board’s conclusions. The minor’s father, the petitioner, told the court that his daughter had been raped and was afflicted with sickle cell disease, a pregnancy-complicating illness. In order to protect her health and wellbeing, he pleaded with the court to permit the termination.
Abortion is prohibited beyond 24 weeks of pregnancy unless there are special conditions, according to the Medical Termination of Pregnancy (Amendment) Act, 2021. The court’s ruling in this instance emphasizes how crucial it is to take survivors’ physical and emotional health into account while dealing with delicate issues.
