Rahul Gandhi petitions the Supreme Court in the “Modi surname” case after the Gujarat HC refused to stay the conviction

Rahul Gandhi has appealed the Gujarat high court’s decision to uphold his conviction in the criminal defamation case by filing a petition with the Supreme Court.Rahul Gandhi, the head of the Congress, has petitioned the Supreme Court to overturn the Gujarat high court’s decision to uphold his conviction in the criminal defamation case including comments about the “Modi surname.” Due to his conviction in the case, he was no longer eligible to serve as a Lok Sabha MP.Gandhi’s attempt to reinstate his Lok Sabha membership suffered a setback on Friday when the Gujarat high court refused to vacate his conviction and two-year prison sentence in a criminal defamation case, finding that the Congress leader “breached modesty” and that his offence involved “moral turpitude.”

As a result of Gandhi’s remarks about the Modi surname before the 2019 Lok Sabha elections, which led to the criminal defamation case and ultimately cost him his Lok Sabha seat, the Bharatiya Janata Party (BJP) claimed Gandhi was a “habitual offender” in terms of insulting people. The Congress announced it would appeal the decision in the Supreme Court.The current conviction affects a significant portion of society, and this court should treat it with the gravity and importance it deserves. Right now, having purity in politics is essential. In dismissing Gandhi’s criminal revision appeal for a stay, justice Hemant P Prachchhak had stated that representatives of the public “should be men of clear antecedent.”
