Twitter Has Failed To Comply With Law Of Land Centre Tells Delhi High Court

The Centre told the Delhi High Court that Twitter had failed to comply with the new Information Technology Rules and the micro-blogging site was a significant social media intermediary which was obliged to comply with the IT Rules 2021.

According to the official reports, the Centre filed an affidavit in Delhi high court, while accusing the micro-blogging site of failing to comply with law of the land, in the form of IT rules. The affidavit stated that even within the three month time which was granted to all significant social media intermediaries to comply with the IT Rules, 2021, Twitter Inc has failed to comply with the same.

The affidavit further added that Twitter has not appointed a chief compliance officer, resident grievance officer, nodal contact person (even on an interim basis) as of July 1, and is not showing physical contact address on its website as mandated under the rules.

Also, the affidavit added that any non-compliance amounts to a breach of the provisions of IT Rules thereby leading to Twitter losing immunity conferred under Section 79(1) of the IT Act, 2000.

In an earlier hearing on May 31, the Delhi High Court had issued notices to both Twitter and the Centre to file their responses while maintaining that the micro-blogging site had to comply with the new IT Rules.
