The Lok Sabha secretariat overturned its order on his disqualification before to the Supreme Court hearing on a case filed by Nationalist Congress Party or NCP’s Lakshadweep MP Mohammed Faizal. According to a notification released on January 13 by the Lok Sabha secretariat, Faizal was barred from membership in the Lok Sabha as of January 11, the date of his conviction in an attempt to murder case by a sessions court in Kavaratti. Faizal had earlier informed the Supreme Court in his appeal that the Lok Sabha secretariat had failed to revoke the notification notwithstanding the high court’s stay of his conviction. His petition was submitted through attorney KR Sasiprabhu.
After hearing Faizal’s appeal on Tuesday, the Supreme Court questioned him about which of his rights was being violated while he was still an MP. Justices KM Joseph and BV Nagarathna’s bench questioned Faizal’s solicitor about which of his fundamental rights had been breached. The court questioned, “Is it a fundamental right?” in response to Faizal’s attorney’s statement that his client has “the right to represent his constituency.” He testified before the court that the Speaker had forbidden the parliamentarian from taking a seat in the chamber. He also demanded that the speaker reverse his decision to disqualify.
