A rape offender’s life sentence was recently lowered by the Madhya Pradesh High Court from life to 20 years after it was recognised that despite committing a diabolical crime, the convict was “gentle enough” to spare the child’s life.
According to a Bar and Bench report, Ram Singh, a 40-year-old criminal, was convicted of raping a four-year-old girl in Indore in 2007 and was given a life sentence in April 2009 by a second sessions court. Singh appealed the decision to the High Court in May 2009.In court, the defendant argued that he had been wrongly suspected of being involved in the incident. He added that there was no chemical analysis report presented by the prosecution. He argued that since he had previously served some jail time, his sentence should be lowered. The child’s vaginal smear was sent to a forensic laboratory, but the police were ruled negligent by the High Court for neglecting to produce a chemical report.
When a bench of Justices Subodh Abhyankar and Satyendra Kumar Singh heard the appeal, they stated: “Considering the demonic act of the appellant, who appears to have no respect for the dignity of a woman and has the propensity to commit sexual offence even with a girl child aged 4 years, this Court does not find it to be a fit case where the sentence can be reduced to the one already undergone by him, but considering that he was kind enough to leave the prosecution’
The survivor and her grandma had exited the hut. It is reported that Singh, who was 25 at the time and used to reside nearby in a tent, lured the girl into the tent by offering her a rupee before raping her. The girl’s medical report indicated that rape had occurred.
