The Prohibition of Electronic Cigarette Act (PECA) 2019 states that the possession of e-cigarettes and related devices in any shape, amount, or manner is illegal. The Union Health Ministry has clarified this. The worrisome increase in young people’s use of it has also drawn the attention of the government.In a clarification sent to the Ministry of Civil Aviation (MCA) last month, the health ministry urged strong implementation of the e-cigarette prohibition, according to the news agency PTI.
Although individual e-cigarette use is not expressly prohibited by PECA, the ministry stated the regulation is intended to completely forbid all uses of these items. This covers e-cigarette manufacturing, sales, distribution, advertising, and all other related activities.Therefore, having any amount of e-cigarettes in the country would be against the PECA, 2019, according to Dr Pulkesh Kumar, deputy secretary of the Ministry of Health.
All forms of electronic nicotine delivery systems, heat-not-burn items, e-hookahs, and comparable gadgets are prohibited under PECA 2019. According to the health ministry, the legislation’s main goal in being passed was to protect the public’s health from potential harm.It should be noted that despite being illegal, e-cigarettes are nonetheless easily available through a variety of outlets, including tobacco sellers, general stores, and online retailers.
