Girl can marry without Parents Consent after attaining puberty

The remarks were made during a hearing in the case of a Muslim couple who married on March 11 against the girl’s parents’ wishes. According to Muslim law, a girl who has reached puberty can marry without the consent of her parents, the Delhi High Court ruled on Tuesday. Even if she is a minor, the girl will have the right to live with her husband, and the provisions of POCSO will not apply to him.Justice Jasmeet Singh made the remarks during a hearing in the case of a Muslim couple who married on March 11 against the wishes of the girl’s parents.According to the police and the girl’s family, the man is 25 years old and the girl was 15 in March. However, according to the Aadhaar card presented in court by her counsel, she is over the age of 19.”It is thus clear that under Mohammedan Law, a girl who had reached puberty could marry without the consent of her parents and had the right to reside with her husband even when she was less than 18 years of age and thus otherwise (is a) minor girl,” Justice Singh wrote in an order dated August 17, the full copy of which was released on Monday evening, according to The Indian Express. The court also stated that the state has no right to enter her private space and separate the couple if she has knowingly consented to the marriage and is happy.
