Texas immigration law is placed back on hold by an appeals court, meaning that state police cannot crack down on migrants

Senate Bill 4, as it is known, is fiercely opposed by the administration of Democratic President Joe Biden, who claims that the federal government, not individual states, should have jurisdiction over immigration issues. In a statement, White House Press Secretary Karine Jean-Pierre stated that “SB 4 will not only make communities in Texas less safe, it will also burden law enforcement and sow chaos and confusion at our southern border.” “SB 4 is just another example of Republican officials politicising the border while blocking real solutions.”

The measure enacted by the Republican-controlled Texas state legislature was temporarily barred last month by a federal court who claimed it “conflicts with key provisions of federal immigration law.”

Earlier this month, the conservative-majority U.S. Supreme Court lifted a temporary stay on SB 4, allowing it to go into effect while lower courts consider legal objections. However, the legislation was rescinded by the 5th Circuit Court of Appeals on Tuesday night. That hold, however, might be overturned once more shortly, allowing the statute to reappear while the debate over it rages.
